ONYX Terms and Services

1. Introduction
Welcome to ONYX. Our services are designed to support individuals in achieving optimal health and performance. Our clinicians are licensed doctors of physical therapy, and our services may include both wellness and physical therapy services, along with specific techniques like dry needling, blood testing through third parties like Vitality Blueprint, SiPhox, and DEXA scans provided by Boston Direct Health. By engaging in our services, website, and social media platforms, you agree to the terms outlined below.
2. Scope of Services
ONYX provides a range of wellness and physical therapy services, including exercise guidance, strength training, mobility exercises, and personalized wellness plans. For clients requiring physical rehabilitation, licensed physical therapy services may be incorporated based on individual health assessments and treatment goals. Additionally, services may include:
• Dry Needling: Provided by licensed clinicians, dry needling may be used as part of physical therapy treatment to relieve pain and improve muscle function.
• Primary Care Services: Through our network, clients may have access to primary care services that support a comprehensive approach to health.
• Blood Testing: ONYX offers blood testing as part of the Vitality Blueprint service, utilizing a functional approach to assess and optimize physiology for peak health and performance. We also offer access to SiPhox blood testing, function health, and other providers. By agreeing to these terms, all clients and patients agree that blood testing is self-administered.
• DEXA Scans (Boston Direct Health): Body composition and bone density analysis through DEXA scans are available in partnership with Boston Direct Health, providing clients with valuable insights into their physical health.
Please Note: Physical therapy, dry needling, blood testing, and DEXA scans are provided within the scope defined by state licensing laws. Wellness guidance, blood testing, primary care referrals, and DEXA scans do not replace traditional medical care unless delivered as part of a licensed treatment plan.
3. Qualifications of Providers
Our clinicians are licensed doctors of physical therapy. Depending on client needs, they may provide services in the capacity of wellness consultants, physical therapists, or both. All services delivered as physical therapy, are intended to address health conditions within the physical therapy scope. Vitality Blueprint services are provided as general health guidance and are carried out by Vitality Blueprint and are not Physical Therapy services. SiPhox testing kits are considered self-administered, meaning the client or patient is administering the test.
4. Limitations and Disclaimers
• No Medical Advice Outside Physical Therapy: Any wellness guidance, blood testing information, DEXA scan results, or primary care referrals provided outside the scope of licensed physical therapy, dry needling, or DEXA scans are not intended to replace medical advice, diagnosis, or treatment from healthcare professionals. Clients should consult their healthcare providers for any specific medical issues or concerns.
• Non-Covered Services: Wellness services, blood testing, DEXA scans, and certain primary care referrals that are not classified as physical therapy are not eligible for insurance reimbursement and are considered outside covered health services under health insurance policies. Clients are responsible for all fees.
• All Physical Therapy sessions are out-of-network, and the client is responsible for paying an agreed upon rate. Clients will have the opportunity, based on medical necessity to file for reimbursement with their healthcare provider. This reimbursement is the responsibility of the client, not their provider or ONYX.
5. HIPAA Compliance
When physical therapy, primary care, blood testing, or DEXA scan services are provided, ONYX complies with HIPAA (Health Insurance Portability and Accountability Act) regulations to protect the privacy and security of client health information. Wellness services provided outside the scope of physical therapy may not fall under HIPAA compliance but still follow our rigorous privacy standards to safeguard client information.
6. Filming and Media Release
As part of our commitment to education and community engagement, ONYX may film or take photos of certain sessions or activities for social media and marketing purposes. By engaging in ONYX’s services, you acknowledge and agree to the possibility of being filmed and/or having your photo taken and grant ONYX permission to use such recordings and pictures for social media content, educational purposes, and marketing, unless you specify otherwise in writing. Client privacy and consent will be prioritized, and no identifying information will be disclosed without prior permission.
7. Client Responsibilities
Clients should be aware of their own health conditions and engage in services only if they are physically able to participate in exercise, wellness, or physical therapy programs. It is the client’s responsibility to inform ONYX of any health concerns or limitations and to seek appropriate medical guidance as needed.
8. Liability Waiver
By using ONYX’s services, including physical therapy, dry needling, blood testing (Vitality Blueprint), DEXA scans (Boston Direct Health), primary care, and wellness services, as well as any interactions through our website and social media platforms, you acknowledge and agree to participate at your own risk. ONYX and its clinicians are not liable for any injuries, health issues, or other adverse outcomes that may arise from participation in wellness or physical therapy programs.
10. Governing Law
These Terms and Services are governed by the laws of Massachusetts, and any disputes shall be resolved within the jurisdiction of Massachusetts.
11. Cancellation Policy
• First cancellation: Clients may cancel their first scheduled session without penalty, regardless of the notice period.
• Subsequent cancellations:
• Cancellations made more than 48 hours before the scheduled session will not incur a charge. Cancellations made within 48 hours of the scheduled session will be charged the full cost of the session.
12. Pricing and Purchases
• Pricing is as followed and clients agree to pay out of pocket for these services:
Evaluation $99.99
60 Minute Session: $199.96
30 Minute Session: $124.98
Home Visits: $349.96
13. Refunds and Transfers
• Refunds for unused sessions or packages are not provided unless explicitly stated in writing at the time of purchase.
• Sessions are non-transferable and may only be used by the individual who purchased them.
14. Code of Conduct
• Clients are expected to arrive on time for their scheduled sessions.
• ONYX reserves the right to terminate services if a client engages in behavior that violates community standards or disrupts service delivery.
15. Insurance Information Disclaimer and Responsibility Waiver
While ONYX may assist in obtaining information about your insurance coverage and benefits, please understand that any details we provide are not a guarantee of coverage or payment. Insurance policies are complex and can change without notice.
It is your responsibility as the patient to verify your own insurance benefits, including co-pays, deductibles, co-insurance, authorizations, and network status. You are financially responsible for all charges incurred for services rendered, regardless of insurance coverage or reimbursement.
16. Changes to Terms
ONYX reserves the right to update these terms at any time. Clients will be notified of significant changes, and continued use of services, including use of our website and social media platforms, constitutes acceptance of revised terms.
ONYX Terms of Service (Consumer-Use; SiPhox Device Authorization by End User)

These Terms of Service (“Terms”) are a contract between you (“you,” “your,” or “User”) and ONYX (“ONYX,” “we,” “our,” or “us”). They govern your access to and use of ONYX websites, mobile or web applications, content, and any non-clinical services we provide (collectively, the “Services”).
By clicking “I Agree,” creating an account, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) What ONYX Is (and Isn’t)
ONYX provides educational, wellness, logistics, and data-viewing tools for consumers. ONYX is not a healthcare provider and does not deliver medical care, diagnosis, treatment, or laboratory services.
Any SiPhox test kits/devices, laboratory testing, telehealth, prescriptions, or clinical review are provided by third parties (e.g., SiPhox/Spot Health/independent clinical laboratories/telehealth groups) and are not provided by ONYX.
Using the Services does not create a patient-provider relationship with ONYX or any ONYX personnel.
2) Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract.
You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.
You may not allow third parties (including a practitioner) to access your account on your behalf.
3) End-User Authorization for SiPhox Device (Consumer-Use Only)
End-User Authorization. If you choose to purchase/register/activate/use a SiPhox device or test kit through or alongside the Services, you explicitly authorize the use of that device/test as the end user. You acknowledge that ONYX does not order, prescribe, administer, collect, process, transport, or analyze your specimen.
Consumer-Use. Your use of any SiPhox device/test is consumer-initiated and consumer-directed. Any sample collection you perform is self-collection.
Practitioner Involvement. ONYX and ONYX personnel may assist in administeration of SiPhox devices/tests as well as supervise, but the user agrees that this is consumer-initiated and is a form a self-collection.
Third-Party Terms. Your purchase and use of any SiPhox device/test are subject to the SiPhox (and/or Spot Health/independent lab) terms, consents, instructions, and privacy practices, which you must review and accept directly with those parties.
4) Content & No Medical Advice
Any information available through the Services is for educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
Always consult your own qualified healthcare provider about questions regarding your health or results. Do not delay seeking care because of something you read or view on the Services.
5) Data; Privacy
ONYX may allow you to view certain health-related data that you upload or that a third party makes available to you. ONYX does not alter, interpret, or validate third-party test results.
Our collection and use of information is described in the ONYX Privacy Policy (incorporated by reference). Third-party providers (e.g., SiPhox/Spot Health/telehealth groups) have their own privacy policies and data practices.
6) Purchases; Third-Party Offerings
ONYX may facilitate access to third-party offerings for your convenience. Such offerings are provided “as is” by the third party, and your contract is with that third party.
ONYX is not responsible for third-party products/services, shipping, laboratory performance, result accuracy, clinical interpretation, or telehealth decisions.
7) Acceptable Use
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to interfere with or disrupt the Services; (c) misrepresent your identity; or (d) share your account with others.
8) Disclaimer of Warranties
The Services are provided “as is” and “as available.” ONYX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. ONYX does not warrant any third-party device/test, lab result, clinical service, or content.
9) Limitation of Liability
To the maximum extent permitted by law, ONYX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits/data. ONYX’s aggregate liability arising from or relating to the Services shall not exceed $100.
10) Indemnification
You agree to indemnify and hold harmless ONYX and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services or any third-party device/test; (b) your breach of these Terms; or (c) your violation of law or third-party rights.
11) Ownership; IP
The Services and all ONYX content are owned by ONYX or its licensors and protected by law. These Terms do not grant you any rights in ONYX’s trademarks or proprietary content.
12) Changes; Termination
We may modify or discontinue the Services or these Terms at any time. If you continue using the Services after updates post, you accept the updated Terms. We may suspend or terminate your access at our discretion.
13) Governing Law; Venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of state and federal courts located in Suffolk County, Massachusetts.
14) Miscellaneous
If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them. Headings are for convenience only.
ONYX Medical & Device Disclaimer
No Medical Care. ONYX does not provide medical advice, diagnosis, treatment, laboratory testing, or clinical services. Content is informational only. Always seek the advice of a qualified healthcare professional for questions about a medical condition, test results, or treatment. If you are experiencing an emergency, call 911.
Consumer-Directed Use of SiPhox Devices. If you choose to purchase or use a SiPhox device/test, you, as the end user, authorize its use and accept responsibility for self-collection and following all third-party instructions. ONYX does not order, prescribe, administer, collect, process, transport, or analyze specimens and does not supervise device/test use.
Third-Party Responsibility. Any test kits/devices, laboratory services, telehealth services, prescriptions, or clinical interpretations are provided by third parties (e.g., SiPhox/Spot Health/independent laboratories/telehealth groups) under their own consents, instructions, and terms. ONYX is not responsible for third-party performance, result accuracy, or clinical outcomes.
Data & Results. Any results displayed to you through the Services are provided for convenience and informational purposes and should not be relied upon for medical decision-making without consultation with a licensed clinician.
